It affects me too. dkms/nvidia- current/ 256.53/ source/ patches/ nvidia- 2.6.36- ioctl.patch (leaving the empty patch inside the folder) then I replaced line 426 of /var/lib/ dkms/nvidia- current/ 256.53/ source/ nv.c with ".unlocked_ioctl = nv_kern_ unlocked_ ioctl," and at the end I reinstalled linux kernel headers --> rebuild nvidia-current kernel module.
I resolved removing the script inside the file /var/lib/
