By "the other" you mean the 2.6.39 kernel? That was only good for testing whether the bug still exists in the newest kernel version. Yes, you can uninstall it.
So the patched one works for you? I think I did misunderstand your comment about the mouse move. Please clarify: It comes up bright when you boot? Then it goes black when you move the mouse? You then use the hotkeys to make it brighter again and now it stays that way even if you move the mouse? The hotkeys still work even after a suspend?
