I have found this BUG_ON doesn't occur with upstream 2.6.25, so finding a point in the past (equivalent to the gutsy kernel, perhaps 2.6.24) and git-bisecting is the best chance.

I'll try to reproduce it with 2.6.24 and kick this off.
