XBMC Crashes Because of Intel Bug (HDMI)

I am having a bug where when I fullscreen xbmc on my LED TV through HDMI cable it crashes. I've talked to the developers with XBMC and they are telling me that it's a bug with the intel driver. Let me know what else I can provide and I'll do so. XBMC works fine when not fullscreened (when it's "restored" or maximized but still showing the window decorations, ie. not fullscreened).
