Privacy UI sometimes fails to update

Bug Description
Rarely (1 in 25?) when unmarking a bug as private the bug does not become public. I performed and observed the following:
1) Click pencil next to privacy
2) Uncheck checkbox by private
3) Click green apply button
4) Spinner starts spinning then stops and privacy box does not turn green
5) Bug report still says "this report is private"
In case it helps I noticed this a lot about 16 hours ago with rss-glx bugs and it just happened with bug 344699. The sceenshot is from after it happened - I clicked the privacy pencil again and you can see what I tried to do.
