Nautilus does not ask for confirmation before emptying trash

in Hardy Heron (8.04)
If after a fresh boot I click the trash icon and then 'empty trash' button (I hope that is the right name , I have dutch version), Nautilus does *not* ask me to confirm my choice, and goes ahead to empty the trash. Eventhough I selected the option to ask me for confirmation,

This *only* happens the first time after a fresh boot.

If during the session I click the trash icon a second time (because there is new trash) and then click the empty trash button, Nautilus *does* ask me to confirm my choice before emptying the trash. (which is the desired behaviour)

I can confirm this issue with Hardy Heron (8.04) - German Version.
It seems to be Nautilus-related indeed and can be reproduced easily:

 · Configure Nautilus to ask on emptying the Trash.
 · Move some files to Thrash.
 · Restart Nautilus, e.g. using the command ``pkill nautilus'' on the shell.
 · Go to Trash and click "Empty Trash".

Nautilus then empties the Trash without confirmation.
